From 1/7/2023, Which polices changes?

A number of new policies take effect from July 1, 2023. Hereafter, Bi Law Firm will introduce to readers a number of new and effective policies, including: VAT reduction, increase in base salary, protect personal data, change in environmental protection fee rates.

1. Value added tax is reduced from 10% to 8%

According to Resolution 43/2022/QH15, the regulation to reduce the value-added tax rate by 2% applies to groups of goods and services currently applying the 10% value-added tax rate (to 8%).

Excluding some of the following groups of goods and services: telecommunications, information technology, financial activities, banking, securities, insurance, real estate business, metals, prefabricated metal products, mining products (other than coal mining), coke, refined petroleum, chemical products, goods and services subject to special consumption tax.

2. Increase the base salary from 1.49 million dong/month to 1.8 million dong/month

According to Decree 24/2023/ND-CP, the base salary will increase from 1.49 million dong/month to 1.8 million dong/month from 1/7/2023.

This salary is applicable to cadres, civil servants, public employees, wage earners, allowances and employees (hereinafter referred to as salary and allowance payers) working in agencies, organizations, non-business units of the Party, State, Vietnam Fatherland Front, socio-political organizations and associations supported by the state budget for operation at the central level, in provinces and centrally run cities (province level), in districts, urban districts, towns, provincial cities, cities under centrally-run cities (district level), in communes, wards, townships (commune level), in administrative units – special economy and the armed forces.

3. Piloting car license plate auction

According to Resolution 73/2022/QH15, the auction of license plates for automobiles will be piloted from July 1, 2023 and will be implemented for 3 years.

Accordingly, the form of auction of license plates is an online auction with the auction method being the method of bidding up. The starting price of a car license plate put up for auction is 40 million VND. The down payment is equal to the starting price of a license plate of a vehicle put up for auction. The price step is 5 million dong. The proceeds from the auto license plate auction, after deducting the expenses for organizing the auction, shall be remitted to the central budget as prescribed.

4. Personal Data Protection

According to Decree 13/2023/ND-CP on personal data protection

Personal data will be secure, and there are penalties to deter, if agencies or organizations infringe on other individuals’ data.

Agencies, organizations and individuals that violate regulations on protection of personal data may, depending on the severity, be disciplined, administratively sanctioned or criminally handled according to regulations (Article 4).

The agency in charge of personal data protection is the Department of Cybersecurity and High-tech Crime Prevention (Ministry of Public Security), which is responsible for assisting the Ministry of Public Security in performing the state management of personal data protection. core.

5. Collection of environmental protection fees for mineral exploitation

According to the Government’s Decree No. 27/2023/ND-CP stipulating the environmental protection fee for mineral exploitation, from July 15, 2023, if the provincial People’s Council has not yet promulgated a new fee rate, the continue to implement the fee collection according to current regulations of the provincial People’s Council.

Specifically, the rate of environmental protection fee for mineral exploitation is different if the mineral exploiter is different, including:

– Crude oil: VND 100,000/ton.

– Natural gas, coal gas: VND 50/m3.

– Natural gas obtained during the extraction of crude oil (companion gas): 35 VND/m3.

6. Policy to prevent domestic violence

The Law on Domestic Violence Prevention and Control 2022 has added communication and educational information; contents of consultation, subjects to focus on consulting and stipulating the responsibilities of People’s Committees at all levels in fostering knowledge and skills in domestic violence prevention and control.

7. New policy on household business registration

Currently, there is a process of connecting business registration and tax registration procedures for business households through the portal.

Specifically, the business household registration information on the business household registration information system is transmitted to the tax registration application system for coordination and information exchange between the two district business registration agencies. and the tax office.

In addition, the policy on granting tax identification numbers to business households instead of business codes as before. A 10-digit tax code is issued to the representative of the household, the representative of the business household, and the individual, and 13 digits to the business location of the household or business individual.

For the application for registration of the establishment of a business household, the business location of the household business; dossiers of change of information, dossiers of temporary suspension, and dossiers of operation termination of real business households will have new forms for the above-mentioned dossier components.

8. The downsizing policy
